1. Introduction

These Terms of Service ("Terms") govern your access to and use of websites, digital products, software, applications and related services operated or made available by TOPCRAW LLC ("TOPCRAW," "we," "us" or "our").

By accessing or using a TOPCRAW website or service, you agree to these Terms. If you do not agree with them, you should not use the applicable website or service.

These Terms are intended to provide a general legal framework for TOPCRAW's corporate website and its evolving digital services. Certain products or subscription services may have additional terms, policies or product-specific conditions that supplement these Terms.

2. About TOPCRAW LLC

TOPCRAW LLC is a limited liability company registered in the State of Wyoming, United States.

TOPCRAW develops and provides digital technology products and services, including software-as-a-service (SaaS) solutions, web engineering services, digital growth solutions and other technology products that may be introduced over time.

3. Scope of These Terms

These Terms may apply to:

• the TOPCRAW corporate website;
• TOPCRAW.com and related digital platforms;
• SaaS applications and online tools operated by TOPCRAW;
• reports, analyses and other digital outputs generated through TOPCRAW services;
• accounts, subscriptions, credits and usage-based services; and
• other digital products or services made available by TOPCRAW.

When a particular service has additional terms, those terms may take precedence over these general Terms to the extent of any conflict.

4. Website Use

You may use the TOPCRAW website for lawful purposes and in accordance with these Terms.

You agree not to:

• use the website for unlawful, fraudulent or abusive purposes;
• attempt to gain unauthorized access to systems, accounts or data;
• interfere with the security, availability or operation of the website;
• introduce malicious code, malware or other harmful material;

5. Accounts

You are responsible for activity occurring through your account, except to the extent that applicable law provides otherwise or the activity resulted from TOPCRAW's own failure to maintain appropriate security.

TOPCRAW may suspend or restrict an account when reasonably necessary to protect the platform, other users, TOPCRAW's systems, or to address suspected abuse or violations of applicable terms.

6. TOPCRAW SaaS Services

TOPCRAW intends to offer digital tools through a unified SaaS platform. These services may include website crawling and SEO auditing, sitemap generation, robots.txt generation, content and AI-assisted tools, link-in-bio services, reports, monitoring and other related tools.

Features, limits, pricing, availability and technical specifications may change as products evolve. Where a material change affects an existing paid service, TOPCRAW will provide notice where required by applicable law or the applicable service agreement.

7. Website Crawling, Analysis and User Authorization

Certain TOPCRAW tools may analyze websites, URLs, pages, technical resources, links, metadata or other publicly accessible web content.

You are responsible for ensuring that you have the right or authorization to submit a website or other resource for analysis. You must not use TOPCRAW tools to access systems or resources without authorization.

You remain responsible for complying with applicable laws, contractual restrictions, website terms, robots directives, access controls and other restrictions applicable to resources you submit for analysis.

TOPCRAW may impose technical limits on crawling, requests, concurrency, URLs, project size or other resource usage to protect the service and third-party systems.

8. Reports, Recommendations and Automated Results

TOPCRAW tools may produce reports, technical findings, recommendations, classifications, summaries or other automated results.

Such results are provided as technical assistance and should be reviewed by the user before implementation. Automated analysis may contain omissions, inaccuracies or interpretations resulting from incomplete, changing or inaccessible source information.

TOPCRAW does not guarantee that following a recommendation will produce a particular search-engine ranking, traffic level, conversion rate, revenue result or other business outcome.

9. Artificial Intelligence Features

Certain TOPCRAW products may include optional artificial intelligence or machine-learning features. AI-generated content, analysis or recommendations may be probabilistic and may contain errors.

Users are responsible for reviewing AI-generated material before publishing, relying upon it for business decisions, or using it in other consequential contexts.

Where an AI feature uses a third-party AI provider, applicable data handling may also be subject to that provider's terms and privacy practices.

10. Plans, Subscriptions and Credits

TOPCRAW may offer free, paid, subscription-based and usage-based services. Plans may include limits based on credits, projects, URLs, analyses, storage, reports, API usage or other measurable resources.

Pricing, included usage, renewal terms and applicable taxes will be presented at the time of purchase or subscription.

Credits or usage allowances generally have no cash value and may not be transferred, sold or redeemed for cash unless expressly stated otherwise. Specific expiration or rollover rules, if applicable, will be disclosed for the relevant product or plan.

11. Payments and Billing

Paid services may be processed through third-party payment providers or merchant-of-record providers selected by TOPCRAW. The applicable provider may vary by product, customer location, payment method or other operational factors.

Payment information may be collected and processed by the applicable payment provider according to that provider's own terms, privacy policy and security procedures. TOPCRAW may not directly receive or store complete payment-card information when such information is handled by a specialized payment provider.

You authorize the applicable payment provider to charge the selected payment method for fees that you have agreed to pay.

12. Subscription Renewal and Cancellation

Where recurring subscriptions are offered, subscriptions may automatically renew according to the billing interval disclosed at purchase unless cancelled before the applicable renewal date.

Cancellation procedures, billing dates and any applicable refund rules will be presented with the relevant subscription or service.

Unless a specific product policy states otherwise, cancellation generally prevents future renewal but does not automatically create a refund for a billing period that has already begun.

13. Refunds

Refund eligibility may vary by product, subscription, usage and applicable law. Any product-specific refund policy presented at purchase forms part of the applicable agreement.

Where no separate refund policy applies, refund requests may be reviewed individually based on the circumstances, applicable law and the nature of the service already delivered.

14. Intellectual Property

The TOPCRAW website, software, platform design, trademarks, logos, source code, documentation, interfaces and other materials provided by TOPCRAW are owned by or licensed to TOPCRAW and are protected by applicable intellectual-property laws.

Except as expressly permitted by law or by a written agreement, you may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer or create derivative works from TOPCRAW software or proprietary materials.

15. User Content and Data

Depending on the service, users may submit URLs, website data, text, files, instructions, project information or other materials ("User Content").

You retain ownership of User Content to the extent you own it. You grant TOPCRAW the limited rights reasonably necessary to host, process, analyze, transmit and otherwise provide the requested service.

You represent that you have the necessary rights and permissions to submit User Content and that its submission and processing through the service will not violate applicable law or third-party rights.

16. Generated Reports and Outputs

Subject to the applicable service terms and payment obligations, TOPCRAW generally intends for users to be able to use reports and other outputs generated for their projects for their own legitimate business or personal purposes.

TOPCRAW does not transfer ownership of TOPCRAW software, algorithms, templates, system architecture or underlying technology merely because those technologies are used to generate an output for a user.

17. Third-Party Services

TOPCRAW may integrate with or depend upon third-party services, including payment processors, cloud infrastructure, analytics systems, AI providers, email providers, storage services and other technology providers.

Third-party services may have their own terms, availability limitations and privacy practices. TOPCRAW is not responsible for independent third-party services outside TOPCRAW's reasonable control.

18. Availability and Service Changes

TOPCRAW will seek to maintain reliable services, but no online service can be guaranteed to operate without interruption.

Services may occasionally be unavailable because of maintenance, upgrades, security measures, infrastructure failures, third-party outages or other circumstances.

TOPCRAW may modify, improve, suspend or discontinue features or services as the platform evolves, subject to applicable contractual obligations and law.

19. Security

TOPCRAW intends to use reasonable technical and organizational safeguards to protect its systems and user information. However, no internet transmission, storage system or software service can be guaranteed to be completely secure.

Users are responsible for maintaining appropriate security of their own devices, credentials and systems.

20. Prohibited Uses

You may not use TOPCRAW services to:

• violate applicable laws or regulations;
• infringe intellectual-property, privacy or other rights;
• conduct unauthorized security testing or access;
• distribute malware or harmful code;
• conduct fraud, deception or abusive activity;
• interfere with service availability or infrastructure;
• circumvent usage limits, authentication or billing mechanisms;
• attempt to obtain unauthorized access to another user's account or data; or
• use automated crawling or analysis capabilities in a way that causes unreasonable harm to third-party systems.

21. Suspension and Termination

TOPCRAW may suspend or terminate access when reasonably necessary because of a material violation of these Terms, suspected abuse, security concerns, non-payment, legal requirements or circumstances that threaten the service or other users.

Users may stop using a service at any time, subject to applicable subscription and payment terms.

22. Disclaimers

To the maximum extent permitted by applicable law, TOPCRAW services are provided on an "as available" and "as is" basis.

TOPCRAW does not warrant that services will always be uninterrupted, error-free, completely accurate, secure, or suitable for every particular purpose.

Nothing in these Terms excludes or limits a consumer protection, statutory warranty or other right that cannot lawfully be excluded or limited.

23. Limitation of Liability

To the maximum extent permitted by applicable law, TOPCRAW and its owners, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, business opportunities or goodwill arising from use of or inability to use the services.

To the extent permitted by applicable law, any aggregate liability arising from a paid service will be limited to the amount paid by the user for that service during the applicable period specified by law or the relevant service agreement.

24. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless TOPCRAW and its owners, officers, employees and service providers from claims, liabilities, damages and reasonable expenses arising from your unlawful use of the services, your violation of these Terms, or your violation of third-party rights.

TOPCRAW's collection and use of personal information is described in the Privacy Policy.

The Privacy Policy and these Terms should be read together when using TOPCRAW websites and services.

26. Changes to These Terms

TOPCRAW may update these Terms as the company, website or services evolve. Updated Terms will be posted on the applicable website with a revised "Last Updated" date.

For material changes affecting existing users, TOPCRAW may provide additional notice where required by applicable law or the applicable service agreement.

27. Governing Law and Disputes

These Terms are intended to be governed by the laws applicable to TOPCRAW LLC and its operations, including the laws of the State of Wyoming, United States, except to the extent that mandatory law requires otherwise.

Any dispute-resolution procedure, venue, arbitration requirement or forum selection applicable to a specific paid service may be established in a separate agreement or product-specific terms.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, the remaining provisions will continue to the extent permitted by applicable law.

29. Entire Agreement

These Terms, together with any applicable product-specific terms, policies and agreements expressly incorporated by reference, constitute the applicable agreement concerning use of the relevant TOPCRAW service.
